It is Happy Head LLC’s policy to respect your privacy and comply with all applicable laws and regulations regarding personal information we collect through https://www.happyheadshop.com and through the Shopify e-commerce platform on which this site is built. This Privacy Policy is incorporated by reference into our Terms and Conditions. By using this Website, you consent to the practices described herein.


This Website sells only over-the-counter (OTC), non-prescription consumer products. We do not collect health or medical information in connection with any telemedicine or prescription drug service through this Website.

Under the California Privacy Rights Act (CPRA), this sharing may constitute “sharing” of personal information for cross-context behavioral advertising purposes. California residents have the right to opt out of this sharing. See Section 12 and our separate CCPA page.

  • Shopify, Inc., which provides our e-commerce platform and processes personal data on our behalf as a data processor. Shopify’s privacy practices are governed by Shopify’s Privacy Policy and Data Processing Agreement.

Happy Head Shop’s mobile messaging service is operated by Happy Head LLC. By opting in to receive text messages, you provide prior express written consent under the TCPA (47 U.S.C. § 227) to receive recurring automated marketing and transactional SMS/text messages from Happy Head LLC at the mobile number you provided, even if that number is registered on any state or federal Do Not Call list.


Types of Messages

  • Transactional/Service: Order updates, shipping notifications, account alerts.
  • Promotional/Marketing: Special offers, promotions, cart abandonment reminders.


Consent Not Required for Purchase

Your consent to receive marketing texts is not a condition of any purchase.

All commercial email communications from Happy Head LLC comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.):

We use commercially reasonable technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. However, no method of electronic transmission or storage is 100% secure.


Data Breach Notification: In the event of a data breach that compromises your personal information, we will notify you in accordance with applicable state breach notification laws, which may require notification within 30–45 days depending on your state of residence. Notifications will be sent to the email address associated with your account.


11. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with legal obligations, resolve disputes, and enforce our agreements. Account data is typically retained for the duration your account exists plus five (5) years unless a longer period is required by law.

In the past 12 months, we have collected: identifiers (name, email, IP address, account ID), customer records (billing/shipping address, payment card data), commercial information (purchase history), internet activity (Website interactions), geolocation data, and inferences about preferences.


Shine the Light (Cal. Civ. Code § 1798.83): California residents may request, once per year, a list of the categories of personal information we shared with third parties for their direct marketing purposes. Do Not Track: We do not currently respond to browser Do Not Track signals. We do honor GPC signals as described in Section 9.


14. Other State Privacy Rights

Residents of Virginia, Colorado, Connecticut, Texas, Oregon, Florida, and other states with comprehensive consumer privacy laws may have rights similar to California’s, including rights to access, correct, delete, and opt out of targeted advertising and the sale of personal information. 15. International Visitors

This Website is intended for users located in the United States. If you are located outside the United States, your personal information will be transferred to and processed in the U.S. We do not knowingly target or market to EU/EEA/UK residents; if you are an EU/EEA/UK resident and believe we hold your personal information, please contact us to exercise your rights.


16. Business Transfers; Children’s Privacy; Third-Party Links

Business Transfers: If Happy Head LLC is acquired, merged, or its assets transferred, your personal information may be transferred to the acquiring entity subject to the same protections described in this Policy.


Children’s Privacy: This Website is not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn we have inadvertently collected such information, we will delete it promptly.


Third-Party Links: Our Website may contain links to third-party websites. We have no control over and accept no responsibility for the privacy practices of those sites.
